When does drunk fornication become rape?

I hate to be blunt but that's what I want to discuss. It's an issue many college students can face. It's an issue that can have severe consequences. Does anyone know that on college campuses it's being promoted that drunk fornnication is rape. Even police and courts get involved. People are going to jail for this. Is it right?

Actually isnt a sober female with a drunk male the same as a drunk female witha sober male?

Personally I think the line should be at physically incapable of refusing to fornicate. At that point I think it becomes rape.

I think it's at least bordering on rape when one person is sober and the other person is too sloppy drunk to be self-aware and the sober person deliberately takes advantage of that. It's definitely rape if a woman passes out and a man has sex with her while she's passed out.

What if one person is more drunk than the other?

And there's also the problem of blackout scenarios. Times when u were really drunk and actively doing things and don't remember them. She or he may say yes at that time and not remember it tomorrow.

By the way I don't think rape has anything to do with being taken advantage of. If a sloppy drunk girl wants sex and the guy agrees then its no where near rape.. Imo

And vice versa. If a guy is sloppy drunk and wants sex and his girlfriend or even another girl agrees then that's not rape either.
