I wasn't able to view the AOL video, so I looked up some more information on this. The case is currently before the Indiana State Supreme Court. I read an article on USA Today and on Indiana Lawyer from last year, and read some entries on this man's blog which is updated regularly.

From what I've read, this is a massive overreach by the Judge and Prosecutor. The man's blog is an awesome source of legal documents - court transcripts, etc which prove his case.

The State is using I.C. 35-45-2-1, Section 1 (d) #6 and #7 as the reason for putting the man in prison. If this is upheld by the State Supreme Court, it essentially opens the door to political prosecutions against anyone the current Prosecutor and State AG believe to be in violation of the following:

(6) expose the person threatened to hatred, contempt, disgrace, or ridicule;
(7) falsely harm the credit or business reputation of the person threatened; or
I'm sorry, but this isn't criminal, and it sure shouldn't be enough to send someone to prison for 2.5 years! Ridicule? We can't even laugh at people now? How absurd.

The Indiana Lawyer article brings out a great point: according to the IN Court of Appeals, Mitt Romney's son's remark that he'd like to punch obama, and the shout heard around the world during obama's SOTU address by Joe Wilson ("LIAR!") would both be in violation.

If that's the case, Ted Cruz, Rand Paul and other should be serving time as well for exposing obama to "hatred, contempt, disgrace, or ridicule." For that matter, round up David Letterman, Jay Leno, Jimmy Fallon, Jimmy Kimmel, Jon Stewart and Stephen Colbert!

This is a special kind of stupidity.

PO mentioned she was looking forward to Mike Pence running for President. He's the governor of Indiana. His AG is pushing the prosecution over this stupid, absurd legal code. I'll be watching how this is handled. As it is now, I wouldn't for Pence based on his AG's actions here.

Thank you for researching this deeper. What a massive power grab by the judge in this case! 2.5 years is a LONG time to be away from your family, what a sacrifice!
