I was rear ended by a driver last summer & while I am in treatment for my back pain the adjuster wants to offer a settlement which on first offer is only 3-7 thousand short of what I would accept.

If they are willing to come that close on their first offer, I'd be willing to bet that they'd pay as much over your offer as they shorted you the first time.
Stick to your guns. Don't accept anything less than what you want. Make sure that what you want over your bills is explicit as well. They are good at making an offer that includes your medical bills while making you think that it's over and above the bills.

Stick to your guns. Don't accept anything less than what you want. Make sure that what you want over your bills is explicit as well. They are good at making an offer that includes your medical bills while making you think that it's over and above the bills.
Amen, I know thier practice is to lowball the offer & the end settlement includes
any past,present, & future treatments (they do pay a portion now but it is only 75% of the medical cost!)

My wife was hit from behind as well in April 2007.
Our insurance under uninsured motorist is what we are going after.
We have a lawyer and what they are offering is double the hospital and rehab treatment bills.
Of which the health insurance folks will want their portion to cover the bills my wife and son built up.
Why should they have to pay if it was not our fault.
So the amount is low after the lawyer and the healthcare folks would be paid.
Our lawyer told us that is the standard first offers.
My wife was not working so loss of income is not in the equation.
We turned down the offer and will most likely take it all the way to the mediating judge panel.
She told us we then have a better opportunity on receiving a fair offer.

Been there before Bro Ron. We got a settlement that was not too far from 100k. It is never enough. I mean the money is great and such, but there is an end to it so it doesn't last forever and also nothing helps with getting back to regular life. In April of 06 my wife was in a serious car wreck. She was 7 mos pregnant and the engine come into the car and basically cut her foot off. The baby is fine (check avatar) they had to put my wifes foot back on. She has not been the same since. Maybe 10 years and she will have it amputated and she might end up in a wheel chair. My wife is 25. The rest of her life is going to be hard but God has helped us alot. The money helped with bills and such, but not with the nightmares. Not with the depression of her feeling like she is not a good wife and mother. She has come a long way and with God's help she will continue to improve. Not only has affected her, but it has affected our relationship of communication and such. We had a real strong marriage before and that is the only way we have made it this far. Even though you were rearended and might get some money out of it. It is never enough. Thank God it was not as serious as my wife's deal. But remember that the money will not touch the change in life that can occur from something like this.

Wow, I am very sorry to hear this. No, money isn't everything & I would much rather have "no accident" than money any day.

Yeah she is. She is the second strongest women I know. The first was my mother that died 3 months ago. But my wife is an amazing and strong women.

Brother, the simple fact of the matter is that if you do not have an attorney the insurance company is not going to take you seriously. They know you have to have an attorney in order to sue them and the law limits the amount of time you have to sue. Without an attorney, they can simply wait you out until it's too late for you to do anything. Also, with an attorney you are much more likely to end up with more money, even after paying the attorney his commission, than you would going it alone. Trust me. I had to learn this lesson the hard way. I waited almost two years before hiring an attorney and could have saved myself quite a bit of aggravation and gotten my daughter's case settled faster and for more money, had I had an attorney giving me the right advice from the start.
These insurance companies are devious and much smarter than you are. (nothing personal, just stating facts) Don't believe the hype you see in tv commercials or hear over the radio commercials. Insurance companies do not care about you. All they care about is MONEY. I highly recommend that you find yourself a good attorney, one that is experienced with your type of case. Depending on Jesus is great. I'm not knocking that one bit. Pray that He sends you a good attorney to represent you well. The insurance companies have attorneys working for them. So should you. :)

I used to think whiplash was just a scam until I was in a car totaled by a hit and run driver on the interstate about 15 years ago. My back and neck were a mess. My back got better in a few months but my neck took about a year.

AMEN! When someone came up with the saying "health is more important than wealth"
I now know they knew what they were talkin about, once you lose health, its a long long way back to regaining even a portion of it., and $$ may pay the bills, buy a few nice things, BUT I'd rather keep my health, thank you., Workers Comp paid me a pittance, even though I had an attorney I fired him after I saw he wasn't doing squat! I so wish I'd not hired him., I lost about $800 that could've been paid to me, but went to him, i was sooo mad., but the LORD makes up for some of the bad things that happen to us, now that same injury may help enhance my SSI/Disability case., for which I've got an attorney., its just a 'time' thing.
AN attorney is the best way all-around to protecting your rights, and informing you, of those rights., youd be surprised what you don't know, until you know it.

Indeed...
I have a friend right now who was in an accident and has severe back trouble...
They are talking 3-10 million right now and every moocher in town is buddying up to him (he was also made to feel so much better by comments from his pastor at the time of the wreck such as... what would the tithes on that be?)
I was telling him the other day... if you get 3 million for instance... dude... that is not a lot of money.
First there are doctor bills, both present and future... BIG MONEY...
Then he will have to pay back the money he and his family is getting now (2 years plus into this right now) to live on plus interest...
Then he has to figure... this isn't lump sum and you go back to work... he can't work anymore... this has to last you and your family the rest of their lives.
In that picture 3 million is a worrisome amount.

I have had 4 surgeries from this accident and pray I don't have to have more. I still have problems with my leg to this day.
Money can never replace health as has been stated, but even if you think you have been "fixed" up and won't have more surgery, you never know.

I was told they moved in the middle of the night before the papers could be served to them. The car was in the parents name and they should have had the insurance.
The son went into the military and the attorney said it was a lost cause.

Remember though this is Canada & insurance payouts are never really high even when going before the courts.
Just came back from the eye doctor exams for my two girls.
They both will need Glasses for distance vision.
My plan at work will reimburse but the way it works is I pay up front then get reimbursed.
I could really use that settlement!
