Charge dropped against man accused of passing gas

CHARLESTON, W.Va. - The Associated Press is reporting authorities are dropping a battery charge against a man who was accused of passing gas and waiving it towards a police officer.

According to a criminal complaint, Jose Cruz, age 34 passed gas and made a fanning motion toward a patrolman after being taken to the police station for a breathalyzer test. Cruz denies making the fanning motions stating he was denied needed restroom privileges.

Cruz still faces driving under the influence and other charges.

He was charged actually because he was hispanic. I live with them and am half of one so I know how lethal they can be...woa...

Well, maybe I'm nitpicking, but if I had been that police officer, I would have been embarrassed to press charges against someone for assaulting me with gas!!!!! Not exactly what I'd call a battle scar. :oops
