How To Murder Your Husband & Get Away With It
Apparently justice is a thing of the past in my state of Tennessee.
Most of you probably read the thread or threads covering the Mary Winkler trial here. It was the case of the Church of Christ pastor's wife who killed her husband as he slept with a shotgun blast. The force of the blast blew him out of the bed on the floor from which he looked up to his wife and said one word as he lay dying "Why?" The latest news now is not only is Mary Winkler going to walk away with just time already served (a little less than a year) but NOW HER ATTORNEYS ARE FILING TO HAVE THE CONVICTION EXPUNGED FROM HER RECORD!!!!!! So not only will this woman get off scot free with murder it won't even be on her record if the judge approves!!!!!!!!!!!!!! |

I thought she was convicted, what happened? |

I always had a hard time with the saying "not guilty by reason of insanity."
I am not saying that is the case here, but if one is guilty-they are guilty! The penalies just are different. This one sounds like a walk. I wonderf if guilt will eat her up. |

Because she had spent almost a year in prison at the time of the trial it was thought the rest of the sentance would be waived and she would just be on probation from her on out. At most a few more months in prison. This latest move by her attorney's to have her conviction expunged from her record once her probation is over astounds and dismays me. Why should someone who shot someone in cold blood as they slept be allowed to have a clear record as if the murder never happened? |

The only thing I can think is maybe there more to the story, so not to bring out her husband embarrassing pass there not saying what really happen. Who knows~ |

We should be asking the law maker why that is. Here you have someone who killed another yet they get a slap on the wrist, then you have someone who may mess up on their taxes they get years in the slammer. Guess money is valued more in this country then taken a life~ |

On what basis was she released?

1) She shot him in the back
2) He asked he "Why?" Those two facts alone tell me something was not right with her. She had some other activities going on in her life and did not want to have to live up to a standard of living required by a ministers wife. You will never convince me that that man did the things she said he did. The trial was all about the actions of a dead man and not the woman who killed him. Shame on the justice system! |

"Winkler had been charged with first-degree murder, but jurors convicted her of the lesser charge after she testified that her husband abused her and demanded sex she considered unnatural. She was given a three-year sentence but had to serve only 67 days in custody because of credit for time in jail before her trial, the nature of the offense and the fact that she had no previous criminal record. Under the terms of her sentence, she spent 12 days in jail and the rest of the time in a mental health facility. " |
This is one of the most grevious miscarriages of justice I have ever witnessed. There was not one iota of evidence that her husband ever abused her in any way.
There was plenty of evidence that she had put her family in a terrible situation through being taken in by one of those Nigerian internet scams. She had lost thousands of dollars, had overdrawn the family bank account by thousands of dollars, was kiting checks to try and cover that, etc, etc. She knew that it was all about to come down around her and OF COURSE her husband was going to be or was furious at that situation. The laslt thing a pastor in a small town needs is his bank account overdrawn by thousands of dollars. She "snapped" under all this pressure and shot and killed her husband in cold blood while he slept. She deserved the death penalty and if not that at least life in prison with no possibility of parole. I know that she will get her just reward some day but I hope that mystical concept of "karma" comes into play and she does not enjoy her freedom. |

I believe she was abused, but I also think she is getting off too easy.

her kiting checks? her falling for an internet scam? her overdrawing their bank account by $1000s? or because she shot the guy in the back? or was it because she got on the stand and contrary to every one else in the known world, said he was a bad guy? |
Man, I thought this was a self help thread, and the only thing that went through my mind was:
Lord, don't let Sis. Jill see this one.... :D Well, never judge a thread by it's cover! :D |
Maybe Mary snapped. You all better watch your backs....tongues..etc.
