The California Governor, Schwarzenegger, who opposes Proposition 19, this morning signed a landmark bill in the state of California which decriminalizes the possession of marijuana. For those wondering, this does not make marijuana possession legal, but it no longer will be a misdemeanor offense. Instead of the mandatory fine of $100 as well as the mandatory appearance in front of a judge, the outcome of being caught with marijuana will now simply be a $100 fine. The new law will be in effect on January 1st and include anyone caught with up to an ounce of marijuana. Basically the possession of the drug is seen no different by California now than speeding is.
Schwarzenegger signed the bill because it will save the state a ton of money since there will no longer need to be a judge and attorneys appointed to each and every one of the misdemeanor offenses involving marijuana possession. Last year alone there were 60,000 Californians caught with the drug, and in the last decade approximately 500,000 offenders.
Schwarzenegger however remains against November’s Proposition 19 (known as Prop 19) vote to legalize the drug.

This is fine as a state law, but if a federal law enforcement officer, (DEA, DOT, ATF) catches them they will face federal punishment and jail time.

BTW another question, how will this affect us on a federal level which still sees it as illegal

Never thought of that. Smoking grass will be a pollutant. Get the EPA to shut it down.

Thats why it is specified as "up to an ounce" . Anything over an ounce is considered possession with intent to distribute. Over an ounce and you are a dealer instead of a user.

The federalies can still bust you.

I don't think thats possible. In the case of Arizona , feds are sueing on the basis of Constitutional rights. This wouldn't fall under that guideline. Many in California have been locked up in federal courts already for possessing and growing it.

If it's decriminalized and eventually legalized will California argue the Feds have no jurisdiction within the state?

Good question, as of right now they do have jurisdiction. I forgot what states already have this same law as California but there are 2 or 3. In those states the feds have and do continue to make arrest on federal laws despite the states lighter laws. However, the feds can make it hard on them. Just as in the case of seatbelt laws and others, the feds can mandate that the states will lose fed funding in some area if they do not adopt fed laws.

Gonzales v. Raich ruled in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use. The court found the federal law valid, although the cannabis in question had been grown and consumed within a single state, and had never entered interstate commerce. Congress may ban the use of cannabis even where states approve its use for medicinal purposes.

In 1973 Oregon decriminalized cannabis[40] Laws changed again in 1995 that reduced penalties. Possession of one ounce or less became legally defined as a "violation" (a crime that is considered a lesser offence than a misdemeanor) and now is punishable by a $500 to $1,000 fine that can be, in some jurisdictions, paid off by means of community service.

Colorado, Alaska, Ohio, and California followed suit in 1975. By 1978, Mississippi, North Carolina,[41] New York, and Nebraska had some form of cannabis decriminalization.[citation needed] In 2001, Nevada reduced cannabis possession from a felony offense to a misdemeanor, but only for adults age 21 and older, with other restrictions

Went with my son to Golden Gate park a few months ago to play disk golf. In some spots, there was an aroma in the air. Son said it "smells like a concert, here". :toofunny

Well, considering that this War on Some Drugs has been a colossal failure...

Maybe if pot's legalized, we can get people to be patriotic and smoke Californian rather than going after illegal drugs that have to be imported.

Not that it matters to me, as being in a room with any smoke makes me want to cough and cough and cough and cough...

Nah. The Feds didn't sue Arizona after Gov. Janet Napolitano signed a law ordering state law enforcement officers to ignore Federal Immigration laws. They did sue when her successor signed a law ordering the same state law enforcement agencies to enforce Federal laws.

The Feds won't sue for this CA pot thing either, nor for the legalization if Prop. 19 goes through. It's just not a hot button issue for the Obama Admin.

Personally, I don't have a problem with pot - growing or possession. Legalize it and rob the cartels of a major revenue stream. That will save lives in the long run in Mexico and along the border. Coupled with real border enforcement it would make Mexico safe to visit again. More importantly, it would make Mexico safe for the Mexican people again.
