Re: Rapist Wants Visitation Rights
This just infuriates me! Why 16 years PROBATION for violating a 14 year old girl?!?! What's to keep him from violating another child? Just the "threat" of jail time if he violates probation!? Ridiculous! Did he get probation JUST so he could create income and provide child support?

As for the rapist, if he wanted to raise a child he should have found a consenting individual, married them like a responsible adult and had children. I have no sympathy for him whatsoever. And yes he should be in prison, and forced to work from the prison with his entire pay going to the child until the child turns 18, then he should be released. |

she should get a restraining order against him.

Re: Rapist Wants Visitation Rights
The sentencing reflects the judge's conviction that this was probably not rape in the usual sense of the word.
I also believe this was consensual and believe that the father should have visitation rights. |

Re: Rapist Wants Visitation Rights
If there had been evidence for forcible rape the sentence would have been prison. In most states a 14 year old can not consent to have sex with someone over 18, so parents or even the state can pick up charges. Yet plenty of 14 year olds are sexually mature or even promiscuous, do not announce that they are underage, and are not readily identifiable as under age by looks or body type.
I can see visitation for the father who ultimately may wind up being a better influence on the child than the mother, depending on where they both go from here. I don't believe it is ever a good idea to cut a parent from a child's life that is capable of being involved in a healthy way no matter their other issues. We already have over a half million kids in the foster/adoption system being raised without parents and their outcomes are not usually as good as even those with marginal parents. |
Re: Rapist Wants Visitation Rights
The problem with this situation is that he was the boyfriend of her friends older sister and they attended the same church. Thus he would have likely known that she was under age when the situation occurred. It is rather unlikely that she would have been friends with a girl four years older than her as the maturity differences are rather large, but it could be possible. The problem is that we do not have enough evidence to truly say which side of the issue is correct.

Re: Rapist Wants Visitation Rights
Something popped off the page to me Jay... There were four counts with ONE girl... Meaning they had intercourse at least four provable times. One does not get forcibly raped by the same guy FOUR times. Chances are that yes he was someone else's boyfriend and when their dalliance became known she suggested he put undo pressure on her for sex in order to avoid the shame of what she had done of her own free will. Unfortunately the parents, in their anger, went along.
This very same situation just happened to a co-worker. Her 15 year old daughter is pregnant by a 21 year old young man. She and her husband had every intention of pressing charges but good sense intervened and they realized that they would be forever driving a wedge in what was to become a family. So they swallowed their pride and met with the young man and his family. Things look promising for him being not only a financial support but also a part of his child's life although neither of them are anywhere near ready for marriage. Not saying that's the whole picture for this story but I'd guess that if the guy is trying to be a father to his child he has honorable intentions and his family may also want to be a part of the child's life. |
Re: Rapist Wants Visitation Rights
I am not in favor of lowering the age of consent, however, when we as a culture insist on teaching sex ed in schools as if they are going to have sex at 14-17, why should we be surprised when children are having consensual sex with adults, especially when they tell them that there is nothing wrong with having sex with anyone that you wish. This gets young adults in trouble with minors at all times. When an age of sexual permissiveness meets the unyeilding law, you have lives that are destroyed. Once again, we see that sin destroys the lives of all involved.
