I personally feel that Turley has the better argument.

Opinion by former Rep Bob Barr

BARR: A Motion To Dismiss For Lack Of Jurisdiction Should Swiftly End The Senate Impeachment Farce

“Unlike other sections of the Constitution where clarity may be obscured by arcane wording, this particular provision is clear and concise, and it applies to “the President.” The language pointedly does not provide in any way, shape, or form that a ‘Former President’ or an ‘Ex-President’ may be similarly punished, only the President,”

It is black-letter law that a court cannot punish someone for a crime if it does not have jurisdiction over that person. Just as courts of law have no power over individuals outside their defined jurisdiction, the United States Senate has no power over a former President of the United States.

Charge Trump with sedition or treason.

He has a Constitutional right to free speech. And he didn’t say anything that promoted a riot.

The Democrats are hypocrites in the highest order with their members fomenting violent speech all last spring and summer.

Trump has been impeached (accused). I seriously doubt he will be convicted.

A conviction in this day and time will say far more about the makeup of the senate as far as liberal versus conservative than it will about his guilt or innocence.

Having said that, I don’t want Trump running for president again. He’s getting pretty old. Surely out of three hundred million people we can find a younger, more qualified candidate. I’m grateful that he shook up the status quo, I just think it’s time for someone to build on what he started.

I don’t know if that would ever happen. Could be. I think either Pompeo or Cotton would do fine. I think Pence has been a good VP but I don’t see him being a president. His is more of a supporting role IMO. Which is not much good. I’m no good at predicting politics.

Trump's lawyers should be in court now asking that this trial be stopped. A private citizen and former President cannot, by definition, be removed from office.

What do you call the Russia Hoax...

What do you call the numerous congressmen and numerous other BHO staff who stated in public and on MSM that they had proof, but when they testified to Congress stated (under oath) that they had no evidence.

These folks you speak of caused the loss of the House. Their false claims made the Repubs keep Trump at an arms length and get little done. It worked like a charm. Thank God for Devin Nunes.

I liked Pompeo but I'm not sure I want a former spook as POTUS.

I'm watching Ron DeSantis. He's got some fight in him, like Trump did, though without the Twitter TS.

I don't want the typical politician, like Ted Cruz or Nikki Haley. I like Cruz but he's become the typical DC politician. I've never been a Haley fan.

Trump is still too polarizing to be ready for another candidate. We will have to wait a little longer. He has created an account at Telegram announcing that he formed the Office of the former President. And his team have two Pro-Trump think tanks in the works.

He has already endorsed Keli Ward in Arizona who won her reelection as Chairwoman of the Arizona Republican Party.

He has also endorsed Sarah Huckabee as she announced her run for Governor of Arkansas.

Trump will be formidable in the future for his own plans and for those they choose to stay the course for the MAGA movement.

After Senators are sworn in as jurors this afternoon, they will have a vote to dismiss. We will see which Republicans don’t understand the Constitution.

How offensive to have a Democrat lead the trial who will also cast a vote. And why is John Roberts not presiding? Because Trump isn’t the President.

The Senate has no Constitutional right to try a Civilian. God help us all.

Leaky Leahy shouldn't be allowed to cast a vote if he's presiding over the trial. Period. You cannot be an "unbiased" Judge while at the same time serve as a Juror who will determine guilt or innocence. I wish the GOP had a spine and threatened to walk if this continues.

Glad Rand Paul is pushing the point of order to force a vote and get people on the record for/against the constitutionality of the process.

Trump is gone. The impeachment trial is to garner a verdict, whether to acquit or find guilty. If he's found guilty, they can't remove him from office because he's already out of the office.

And if their end game is to try to pass a bill to ban Trump from running in 2024, I don't see how it will hold up in court.

I dare say that I follow him more closely than you do. Take your suggestion on the bias and blinders, David. Words matter. You can’t use that excuse to accuse people who don’t agree with you.

He is the one that wanted to help settle the country down by having an emergency 10-day audit that he got the other Republicans to agree to.

That was turned into a lie that he wanted to overturn the election.

These people are not going to know what to do when Trump is finally out of a news cycle. They've depended on him. They've fed the coals of their inexorable hate. He fed off of their hate and provoked and trolled.

But at some point, China's going to heist their leg on Taiwan. And Uncle Joe is not going to be able to claim some political inheritance when he has to "do something."

In fact, a whole BUNCH of comeuppances are on the way, and at some point it becomes Biden's mess.

Impeachment is simply a way to keep Trump in the news cycle, because losing Trump to report on Biden is the equivalent of going from the hot tub to the frozen pond. And the obvious genuflecting going forward will hurt the media reputations even more.

It's like this:

Advisor: "Mr. Biden, Chinese soldiers are bayonetting Hong Kong dissidents. What are you going to do?"

Biden: "Where's Trump?"

Advisor: "Trump isn't here, sir. The press is outside."

Biden: "Hey, Didn't Hunter have child-porn on that laptop?"

The republicans turn into ravenous pit-yorkies when they're in the minority. They had the chance to scale back things when the were granted the trifecta in 2016.

They didn't. They somehow let that appalling John McCain become the rudder of a disastrous mid-term ship.

How appalling is/was McCain? I think he got the nomination in 2008 to LOSE ON PURPOSE. And the cynical treatment of Sarah Palin proves it.
