Two women have been placed on unpaid leave and could lose their jobs after a photo they took near the Tomb of the Unknown Soldier at Arlington National Cemetery went viral on the Internet.

I believe this would fall under free speech. I don't think she was at work, but on vacation.

Yes, some say it does fall under free speech. She was on a work related outing.

Even if she was on vacation, what you do and say outside of work can affect your employment and/or hireability.

Many brave men and women have died, giving her
the right to do what she did. Nonetheless, if I were
her employer, she would definitely be fired.
