No Miranda Rights For Bombing Suspect
 
A Justice Department official says the Boston Marathon bombing suspect will not be read his Miranda rights because the government is invoking a public safety exception.

Don't agree with this. Nor do I agree with the warmongers Graham and McCain demanding he be labeled an enemy combatant to be kept out of federal court. He's a US citizen who committed a violent act like Timothy McVeigh. He should be tried in federal court just like McVeigh.

Everybody gets all giddy when someone is denied Miranda. I have heard news people say this man will be executed etc.

No matter how undeniable ones guilt may seem everyone should be afforded their rights under the Constitution (you know... those unalienable ones) and should also receive a trial from a jury of their peers. We are innocent until proven guilty.

This country is growing far too comfortable with deciding exactly who does and does not get rights afforded us ALL under the Constitution.

Just wondering who would be considered his "peers"?? Would they have to be from Russia? Could they be people who were born here in the USA? or would they have to have become American citizens? Seriously, I'm just curious. I could see this becoming a major sticking point in a trial - unfortunately.

He is a legal permanent resident of the United States of America. His peers would be residents of the United States of America. We don't hold trials where we import jury members from another country. Even if an illegal alien stood trial for murder the "peers" would be other Americans.

I don't know of any situation where we deviate from that definition of "peers".

The reason why they want to not issue the Miranda and keep him as an enemy combatant is for possible intell from interrogations.

As soon as you read him his rights and he "lawers up", you lose that ability.

Though he was a citizen, his brother was not and had possible ties to enemy combatants and spent the last 6 months (Nearly) in Chechnya. His Youtube account was plastered with Terrorist propaganda
