Wow. Any legal minds out there? Could this even be enforceable? Surely the limitation stating that if they resign or are fired, they can't work within a 50-mile radius of ABC's couldn't be legally upheld.

"Any type of attitude will result in immediate termination."

So does that mean one couldn't be HAPPY? What a stupid statement.

Didn't seen this story yet. Since, I'm no longer at the school I''m not working within earshot of them anymore, but it is always interesting keeping up with certain types of insane people.

"No competition" clauses are legal, but I haven't heard of a restaurant owner trying to enforce one.

The $250 fee for not showing up is a real gem though!

But I would think the huge, 50-mile, radius of the clause would place an undue burden on any employee, and would be struck down. I mean, most of their employees were young; likely from within a 5 mile radius of the restaurant, which means I doubt they 1) would want to drive 50 miles away for a job; 2) may not be able to, due to either lack of transportation or relying on rides.

Trying to enforce a no competition contract can be costly for the former employer. Sometimes it just is not worth it. Although, I wouldn't put it pass these people.

Isn't it pretty common to charge employees for broken dishes? Not sure about the food.
