No doubt the Spirit brings conviction to the sinner, I agree with you on that. If they haven't received the Holy Spirit then they aren't going to confess Jesus as Lord.

What the scripture is saying is that those who truly speak by the Spirit will confess that Jesus is Lord, and not that he is accursed. Anyone claiming to be speaking by the Spirit and curses Christ is not speaking by the Spirit.

The context of this verse is not saying that sinners are filled with the Spirit before they are filled with the Spirit.
