Maybe, but no apology would have stopped the lawsuit any way.
And, for the record, I would only ever apologize for the public comments, not for feeling she committed sin.

Do you feel she commited fornication by being in a bikini in mixed company?

Mizpeh,
I'm thinking the pastor believes she had motivation by her apparel? Hence, he calls it fornication.

Okay, I meant to get off of here hours ago, but this is making me nuts!
So, now others can declare (publicly, no less) that we have sinned a specific sin because they think they know our motivation??? Yeow!!!
Only God knows our motivation.

Sorry, I missed this. Sometimes our outward appearance shows our motivation. Take Jezebel? The Bible specifically tells her motivation by her apparel. Sometimes, our outward dress and actions are going to show our heart.

Unlike women that commit fornication and adultery with co-workers, having never worn a bikini in front of them?

Sure, you can commit adultery wearing whatever. I agree! You can be wearing a wedding ring and it doesn't mean a thing. But she was wearing bikini and shouldn't have been.

That wasn't his defense.
His defense was:
One of the reasons the pastor gave James Driver as grounds to biblically remarry was that James Driver once found his then-wife Angela Driver wearing a bikini at a swimming pool while with the husband of a mutual friend. The pastor felt that constituted exhibitionism and met the biblical definition of fornication, according to the defense summary.

He said that exhibitionism (his term for wearing a bikini in front of another man) was fornication.
