That wasn't his defense.
His defense was:
One of the reasons the pastor gave James Driver as grounds to biblically remarry was that James Driver once found his then-wife Angela Driver wearing a bikini at a swimming pool while with the husband of a mutual friend. The pastor felt that constituted exhibitionism and met the biblical definition of fornication, according to the defense summary.

Because without naming the man, it almost reminds me of the woman caught in adultery-"in the very act", in the Bible. The woman was brought before Jesus and accused. They caught her in bed in adultery. What, did they lose the man in the sheets? Forget him in their zeal to stone her?
For the record, no I don't think that this woman was in adultery or fornication for wearing a bikini. We don't know who the man was or his motive for being there. He could have been a relative, or he could have walked up while she and her friend were at a private backyard pool for a girls' day. That happened to me once, but believe me, it wasn't fornication. He didn't go to a UPC. He walked up and started chatting, not realizing that he wasn't supposed to be there. What was more immodest? Staying in the water or standing up and getting out, giving him a full view?

They both had a mutual friend (I'm assuming the mutual friend was a woman). The man at the pool was the husband of the mutual friend.

I definitely think it was terrible judgment, and she may have had bad motives. However, there's no proof that anything occurred beyond immodesty. That alone doesn't constitute fornication or adultery, ergo just biblical cause for divorce/remarriage.
