And there are homosexuals that oppose same-sex marriage!

I see your point about the judge's bias. However, a judge's primary duty is to overcome duty in his interpretation of the law. This has to be demonstrated usually before they are appointed to the State Supreme Court or any other major court. FTR, this particular judge was appointed by Conservatives, and happens to be a constitutional conservative as well.

Right. But I think it would be far to ask the judge how he feels just as they do to potential jurists before a trial

I agree.

But what if the judge said he was a "traditional family" guy? What then? Can we find an objective judge?

I am sure we can find an objective judge. I'm sure some smart lawyers can think of some more questions to ask him to determine if he can be impartial. That alone,being his personal preference, is not enough.

I don't think a person being gay is automatically enough to have him excused either, but I think they should ask him questions just as they would jurists
