Yes, it is lopsided...and when they were enacted they needed to be lopsided to fix a lopsided problem. It is not silly, maybe just a little outdated at this point as the very real problem that they were designed to addressed has subsided significantly. Personally, I don't think any of it is silly and I think that calling it that trivializes the reason they were necessary in the first place.
I think that now we may be able to undo the hate crime designation....not because it is silly and always has been silly, but because the very real problem it was designed to fix does not exist anywhere near the same degree.
I think that it was an effort for the federal government to send a clear message, particularly in light of the fact that in some regions local government was sending the wrong message.
