If they lose there then they can take to to a civil action in the federal courts. This means years and years of depositions where you have to answer questions about every personal thing in your life from the time your are a child. After about six or seven years of that you will probably regret the fact you didn't stop and think first.

And of course if you stop and think too hard, you could spend eternity regretting you didnt stop someone from killing your family .
