according to some defense and prosecution lawyers. since the man was on his back he could not retreat. in every state self defense would have held.
However in florida one does not have to retreat in order to claim self defense.
The father of the son who was shot, stated that the voice screaming on the 911 audio was not his son.
The prosecution based a case off of inconclusive evidence to charge the man just to make the media happy. (its a terrible loss) but second degree murder wont stick to this man.
They should have brought a manslaughter charge against him from the start. However i believe there is enough evidence to have the charges droped.
More than likly the judge will not dismiss the case and the man will fall into a biased jury and get convicted, because of the way the media lied and handled this case.
