Why gun the engine? That is what makes a lot of people believe this was no accident. IMO, if you see someone on a track, you don't gun the engine unless you're trying to scare them. That's what I believe happened. Stewart wanted to scare the guy, gunned the engine, the car fishtailed and he ran him over. In that case, and I may be wrong, he should be charged with vehicular manslaughter.
