I know Mark Fogarty. I do not know her.
I'm a hypocrite, and completely biased.
I would ignore someone who was threatening to sue me as well.

I do think everyone on this thread have missed the reason why Fogarty did not apologize. First, he may not have felt he did anything wrong. Second, he may have believed an apology would be viewed as an admission of guilt, and used against him in court.

Maybe, but no apology would have stopped the lawsuit any way.
And, for the record, I would only ever apologize for the public comments, not for feeling she committed sin.
