One of us have been divorced for 13yrs, one had their (husband/wife) disappear 10+years ago back to a foreign country then that person died 4 years ago, but due to foreign records and unknown exact location proof of such has not been found...
So yes, the complications are that of one is legally still binded and although the process has started, due to publications being able to marry is about 4months out.
No, separating until then is not an option.
We've been together 8+years... so the "temptation" to break abstinence is well controllable lol

It looks like to me if you are sure that the person is dead, you would not have a problem in getting married. Unless things have changed, when you go to apply for a license, you don't have to prove divorce or death papers. You are asked for the number of marriages and divorces but did not have to prove it. AS I HAVE SAID, THE RULES COULD HAVE POSSIBLY CHANGED. When we moved to a new state and went to get our driver's license, I had to bring my birth certificate, marriage license, proof of current address, S.S. # and current driver's license. THANKS TO OBOMA..
YOU COULD ALSO CHECK WITH SURROUNDING STATES TO SEE IF THEIR LAWS ARE THE SAME AS THE ONE YOU ARE APPLYING IN. - JUST AN IDEA.

i am about to get in serious trouble with my AFF friends, I suspect.
So we are talking about 2 people getting married in the eyes of GOD here right?
Do we really care about the eyes of the state?
What did people do before there was a state to recognize their marriage?

Hey Newbie, I have a very important question for you.
Do you and the person you live with have the same belief system? Are you both now committed to Jesus in the same way? Go the same church? have the same conviction?
The following advice is based on YES being the answer to the question(s) above.
You need to avoid fornication. that is the sin. You need to "flee" putting yourself in a position to be tempted. That is also potentiallu sinful.
Now how do you do that?
My view is that what you need to do is be married in the eyes of God. That can be accomplished (again in my humble opinion) without state ratification.
If the two of you are going to church together, share the same faith, have committed in your hearts to one another, and are fully prepared to commit to each other in a covanant relationship with God, then it seems to me, you need to get with you pastor and get that done.
4 months from now, sign some legal documents that square you with the state but get yourself square with God now.
That can be done today if your pastor is ameniable....
if he is not, please discount all i just said and proceed as your pastor directs...

In fact, I can almost imagine a dual ceremony. Perhaps a bit awkward in some ways, none the less I think it would be beautiful to hold the marriage ceremony, then both get baptized (an hour or two later), then escape for a quiet week in who-knows-where.
