SCOTUS: 5-4 in Favor of SSM

SCOTUS rules 5-4 in favor of SSM.

Chief Justice Roberts, Justices Scalia, Alito and Thomas dissented.

The opinion is definitely worth reading. Justice Kennedy wrote the majority opinion. Chief Justice Roberts wrote the dissenting opinion.

What are the States waiting for? It's time to invoke Article 5.

Re: SCOTUS: 5-4 in Favor of SSM

JUSTICE SCALIA, with whom JUSTICE THOMAS joins, dissenting.

I join THE CHIEF JUSTICE’s opinion in full. I write separately to call attention to this Court’s threat to American democracy.

The substance of today’s decree is not of immense personal importance to me. The law can recognize as marriage whatever sexual attachments and living arrangements it wishes, and can accord them favorable civil consequences, from tax treatment to rights of inheritance.

Those civil consequences—and the public approval that conferring the name of marriage evidences—can perhaps have adverse social effects, but no more adverse than the effects of many other controversial laws. So it is not of special importance to me what the law says about marriage.

It is of overwhelming importance, however, who it is that rules me. Today’s decree says that my Ruler, and the Ruler of 320 million Americans coast-to-coast, is a majority of the nine lawyers on the Supreme Court. The opinion in these cases is the furthest extension in fact—and the furthest extension one can even imagine—of the Court’s claimed power to create “liberties” that the Constitution and its Amendments neglect to mention. This practice of constitutional revision by an unelected committee of nine, always accompanied (as it is today) by extravagant praise of liberty, robs the People of the most important liberty they asserted in the Declaration of Independence and won in the Revolution of 1776: the freedom to govern themselves.

Hubris is sometimes defined as o’erweening pride; and pride, we know, goeth before a fall. The Judiciary is the “least dangerous” of the federal branches because it has “neither Force nor Will, but merely judgment; and must ultimately depend upon the aid of the executive arm” and the States, “even for the efficacy of its judgments.”26 With each decision of ours that takes from the People a question properly left to them—with each decision that is unabashedly based not on law, but on the “reasoned judgment” of a bare majority of this Court—we move one step closer to being reminded of our impotence.

Re: SCOTUS: 5-4 in Favor of SSM

There are some brilliant men on the SCOTUS.

Having said that, recent decisions is an indication that we have failed.

We, as a nation have failed the founders and what they put together for us, at great risk of fortunes and blood.
We have failed all those that have held our constitution as the ultimate law of the land.
We have failed all those that served, was wounded or died to protect the liberties this document afforded us.
We have failed this genration.
We have failed succeding generations.
We have failed the world.
We have failed ourselves.
But most importantly, we have failed God.

Is it too late?
No, but unless God's people, which are called by His name, shall humble themselves, and pray, and seek His face, and turn from their wicked ways; then will I hear from heaven, and will forgive their sin, and will heal their land.

Nah, we'll just vote some more, that'll fix it. No need for national repentance. THAT might come across as mean, intolerant, pushing religion on others, trying to set up a theocracy, Christian Talibanism, blah blah blah...

Biblically speaking, it's impossible to have a christian nation, so what's all the fuss about??

The world will always be the world...why do people hold an earthly nation to heavenly standards???

The fuss isn't about whether or not this is Christian nation... the fuss is it just got a whole lot harder for Christians, and most of us don't even realize it. I'm contemplating just staying overseas....

Re: SCOTUS: 5-4 in Favor of SSM

Plain and simple, the Congress is the only legislative branch of government and by constitutional mandate are not allowed to share that power with any other branch of government. The SCOTUS has breached it's power as the Juduacial branch by legislating this to be the law of the land and not ruling on the case and sending it back to the states to work further as the 10th Amendment states. This is a breach of Judicial powers and Congress has every right to shut it down, and can do so with just a simple vote ... however the longer the inaction of Congress the more likely it is to stay the law of the land, and the SCOTUS decision to be the one upon which all future legislation is matched against thereby creating case law. This is the first time that I know of that the Supreme's have legislated from the bench, but if they get away with this nothing will be taboo. It is a bad day for the Republic!

We??? We? How have WE? failed in all of these?

I will readily admit that we regularly disappoint God in our decisions... etc

But I didn't make this decision. I abhor this decision.

The 5 people of the majority opinion failed the founders and what they put together for us, at great risk of fortunes and blood.
The 5 people of the majority opinion failed all those that have held our constitution as the ultimate law of the land.
The 5 people of the majority opinion failed this generation.
The 5 people of the majority opinion failed succeeding generations.
The 5 people of the majority opinion failed the world.
The 5 people of the majority opinion failed US!!!

It is not over, not yet. Do I have control over what our Judicial branch decides to do? No, but it is not a failure on my part or Christian's parts. Christians as a group have failed many things but not these things. We have failed to accurately portray the love that God has for these people identifying themselves as homosexual.

Christians have failed to humble themselves and be meek in response to the calculated and patient attack on our values. It is not our job to make up people's minds it is our job to inform them of the mind of God. What His opinion of certain issues is. If they choose to accept it, wonderful. If they choose to ignore it, we pray for them. We teach our children to love the sinner and hate the sin as God does. We pray..... and pray.... and pray..... and pray..... and pray.....

I will readily admit that I have FAILED to pray as much as I should. I have FAILED to mourn the sin of this world as much as I should. I have FAILED to be as meek as I should so I will inherit the earth. I have FAILED to hunger and thirst for righteousness so I will be filled.

This decision is not my failure. But, I am not dead, yet. I have a chance to repent and succeed in correcting MY failures and be successful in doing the things I should. If we do what we should and act in the manner we are biblically mandated to act and pray, maybe things will change. I know if we do at the very least we will be changed.
