What John said was, "It is not lawful for thee to have thy brother's wife."
The unlawful act was not the fact that it was a "2nd marriage," but that it was a brother marrying his brother's ex. Under Moses' law a divorced woman was free to marry whoever she wished except certain close family members of her ex-husband.

I think most folks would try and make your case using the last half of
Matthew 19:9.
