I saw a guy on a TV show that wanted to legally marry his horse.

I say make a constitional amendment to permantly ban gay marriage.

Animals do have "rights" though they are limited compared to the rights humans are recognized as having. You cannot "marry" a goat in any state because all marriage laws are directed toward humans and have language that specifies this.

Further, you cannot even ... er, ... have a "dalliance" with a goat in any state of this union because the goat's person is protected against human sexual advances. The goat (and every other animal) has been deemed by the courts to be unable to grant consent to your advances and thus you will face fines and jail time if you were to attempt to ... er, ... violate the goat's person.

Ummm Equal protection is not exactly founding fathers. Add about 100 years to get to the Equal protection clause.

Also this fails under equal protections intent. The intent is that the laws are applied equally. You can't say a black man can't marry but a white man can. No man can be married to another man under the California law there is no inequality. Inequality would be saying Asian men can't marry, but white men can. Defining marriage has ALWAYS been the right of the States. If this holds it will bring into play the full faith and credit that is required by the states. SO any state that allows two men to be married must be recognized by all other states.

Wouldn't have to examine the language of the relevant statutes in each state. In my state it specifically says "human beings" and "man" and a "woman." Thus, farm animals and wildlife are not allowed before the county clerk's desk. Nor, for that matter, are "same sex" couples.

That's my point. The judge has said California doesn't have the right to regulate "who" is married.

I believe you are speaking of a revolution at the ballot box?

It is one thing for a State to say they want to sanction gay marriage it is another thing for a lone judge to declare that Gays have a constitutional right to marry someone of the same sex. The reality is they are free to marry, they just can't marry someone of the same sex.

When do judges get to toss the age of consent for marriage? They have already done this in some states with abortion, by giving a judge the right to sign off on a minor receiving an abortion without the consent of the parents.
