Constitutional Question

The first line of Amendment Twenty Two, Section One reads, "No person shall be elected to the office of the President more than twice..."

Now I'm not illiterate, and understand two terms, but my question is this...

Let's say someone's second term was coming to a close...and suppose a man or woman running for office of president wanted the current POTUS as a running mate...could they? Is that legal?

Theoretically it sounds legal, as the new VP will not be elected to POTUS, but another office. In the event of a succession of office however, I imagine it would create a dispute.

Of course, nobody in power cares about the Constitution. The current POTUS is not a natural born citizen and nobody's done anything, so why would anyone do anything about some other violation of the USC?

The 12th amendment outlines that a VP candidate has the same requirements to run as the President does so a 2 term president would be ineligible to serve/run as VP.

I understand that there is some contention on this as it has never gone before SCOTUS. that being said, in my humble opinion, no. the 12th rules out a 2 term president as VP.

Thankful for the great minds here enlightening me on this...I found this re the Twelfth Amendment...

"There is a point of contention regarding the interpretation of the Twelfth Amendment as it relates to the Twenty-second Amendment, ratified in 1951, which prohibits a person from being "elected" President more than twice.

While it is clear that under the Twelfth Amendment the original constitutional qualifications of age, citizenship, and residency apply to both the President and Vice President, it is unclear whether a two-term president could later serve as Vice President.

Some argue that the Twenty-second Amendment and Twelfth Amendment both bar any two-term president from later serving as Vice President as well as from succeeding to the presidency from any point in the United States presidential line of succession. Others contend that the Twelfth Amendment concerns qualification for service, while the Twenty-second Amendment concerns qualifications for election, and thus a former two-term president is still eligible to serve as vice president.

The practical applicability of this distinction has not been tested, as no former president has ever sought the vice presidency, and thus the courts have never been required to make a judgment regarding the matter."

I'm sure y'all figured out why I was asking this. After watching HRC on CNN today, I was thinking about what might happen if she asked BO to be VP, and wondering if the two terms meant two consecutive terms.

2008 called. They want their smear campaign back. No one has done anything cause the POTUS is a natural born citizen.

I doubt she would ever choose BO.

they pretty much hate each other.

She did say at one point that she would love to pick Bill, but her advisors have stated that would be unconstitutional.

There are some who seem to want to twist the twelfth into a pretzel but most of those are conspiracy minded people. reality is, there just is not way SCOTUS would allow it. the 22nd is very clear in its intent.

Nobody knows for sure where he was born but Kenya seems to think he was born there.

As for Cruz, I and others have been yelling it from the get go. Some filed lawsuits. But the PTB haven't seemed to interested in opening that Pandora's box for some reason...
