Recording laws are different depending on the state, many states allow you to record a conversation as long as one party knows it is being recorded but there is nothing to stop a government agent from listening if he isn't recording. Not listening in on your line just listening to you.
People record your audio all the time, go to church and shout "Praise the Lord" real load and the mic picks up your voice and you have been recorded.
