It depends.
Is he talking about it? If so, his words alone are not my justification to shoot him. I would be convicted in ANY court of law for killing someone simply because they convinced me they were going to shoot me if I let him.
Is he reaching for the gun that I know or can reasonably believe that he has in his pocket?
I'd feel justified in DEFENDING myself in that case.
Is it my right to stop him from purchasing or acquiring his gun? No.
If he is pointing the gun at me, it might possibly be too late-- so what am I to do? Point my gun at someone who is potentially unarmed before they can point what they have or don't have at me?
Pre-emptive strikes risk being perceived as nothing more that unprovoked acts of war.
The bombing of Pearl Harbor could be argued as a pre-emptive strike!
