Your asking irrelevent questions.
First off, you can grandfather in the 'has beens'
Second, doesn't matter what I 'think' we would do, you asked what possible charges 'could be' considered.
Third, doesn't matter what the US has ever done in the past because it has no bearing on what your asking could be done in the future.
If you look at it realistically, I do believe she should be charged with at least manslaughter. Maybe neglegent homicide. But the one performing underground abortions should be charged with murder.
